Dear Senator :
I am writing to urge you to strongly oppose the so-called Employee Free Choice Act, (EFCA). EFCA seeks to replace the current process of private ballot union representation elections with a system called “card check,” which can expose employees to coercion by union organizers and their peers. This legislation will also impose an artificial timeline for when the first labor contract must be reached when a union is certified. Here a federal arbitrator could dictate the terms of contract, including wages, benefits and work rules.
Private ballot elections are the cornerstone of the democratic process and the elimination of this process is a direct infringement on our labor law system’s longstanding principles of fairness and balance. When this system is at risk it can hinder economic growth and threaten job creation. In addition, imposing contract terms through compulsory arbitration is an unconstitutional infringement on the right of private employers to freedom of contract. During hearings in 2007, Members of Congress heard how union organizers routinely pressured workers in cases where Card Check was allowed under current law. Why would anyone want to subject millions more workers to this treatment?
It is my hope that when you consider this legislation, that you will vote pro-manufacturing and pro-worker – and against EFCA. The provisions of this legislation are individually harmful to manufacturers, but together are devastating. Congress should not consider or support measures that would threaten our economic competitiveness.
